Chinmoy Krishna Das Brahmachari, spokesperson for the Bangladesh Sanatan Jagaran Mancha and principal of Pundarik Dham in Chittagong, had his bail hearing deferred on Tuesday (3 December).
The hearing was scheduled in the court of Chittagong Metropolitan Sessions Judge Md Saiful Islam, but no lawyer appeared to represent him, and the prosecution also sought an adjournment.
Consequently, the court set the next bail hearing date for 2 January 2025.
Assistant Public Prosecutor (APP) Advocate Enamul Haque told media that no lawyer was present in court on behalf of Chinmoy Das.
Simultaneously, the prosecution requested additional time for the hearing. The judge, citing these circumstances, postponed the bail proceedings to early next year.
Since the hearing did not take place, Chinmoy Das's legal team currently has no recourse to the higher courts.
Moreover, with the case pending in the Sessions Judge Court, the option for a bail plea in the Magistrate Court also remains unavailable, Advocate Haque added.
Ultimately, however, the decision to grant or deny bail lies with the Metropolitan Sessions Judge Court.
If bail is denied there, Chinmoy Das’s team can further approach the higher courts or file for bail proceedings in the Magistrate Court.
This delay prolongs Chinmoy Das's custody, raising questions about his immediate legal recourse and the complexities surrounding his bail application process.
